Terms of service

1. Scope of Application
These General Terms and Conditions (AGB) apply to all orders placed through the online shop of **umewe** (hereinafter "the Seller", "we", "us"). The AGB govern the contractual relationship between us and our customers (hereinafter "Customer", "you"), who purchase products through our online shop. Deviating conditions of the buyer do not apply, even if we have not expressly objected to them.

2. Provider and Contractual Partner
The contractual partner for purchases in the online shop is:
umewe
Owner: Nisa Anton
Buckhörner Moor 110
22846 Norderstedt
Germany
E-mail: info@umewe.eu

3. Conclusion of Contract
3.1. The presentation of products in the online shop does not constitute a binding offer to conclude a purchase contract, but rather an invitation to order products.

3.2. Customers can initially place our products in the shopping cart and may correct their entries at any time before submitting their binding order using the correction tools provided in the order process. By submitting the order through the online shop, the customer makes a binding offer to purchase the products contained in the shopping cart and receives a confirmation email. The purchase contract is concluded only when the seller ships the goods to the customer. The customer will be informed of this with a second email (shipping confirmation).

4. Prices and Payment
4.1. All prices are inclusive of the statutory value-added tax. The purchase price consists of the total price of the goods and shipping costs. Shipping costs will be displayed to the customer before placing the order. In the case of international delivery, the customer bears all customs duties as well as import and export fees.

4.2. Payment can be made according to the customer’s choice via:
- Credit card
- PayPal
- Prepayment by bank transfer

Credit Card:
In the order process, you will enter your credit card details. Your card will be charged immediately after submitting the order.

PayPal:
To pay via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be processed by PayPal immediately after the order is placed. Further instructions will be provided during the ordering process.

Bank Transfer:
If you choose to pay by bank transfer, you will receive our bank details after placing the order. Please transfer the total amount to the specified account, indicating the order number as the reference. Your order will be processed as soon as the payment is received and confirmed, which may take several business days. Please note that bank transfers may take longer to process compared to other payment methods.

4.3. Shipping After Payment Receipt:
The goods will only be shipped after the full payment has been received. If payment is not received within 14 days of order confirmation, we reserve the right to cancel the order and not accept the offer. In this case, the customer will be informed by email.

5. Retention of Title
The goods delivered to the buyer remain the property of the online shop until full payment has been made.

6. Delivery
6.1. Delivery is made to the shipping address provided by the customer. We only deliver via shipping. Self-collection of the goods is unfortunately not possible.

6.2. Delivery times and costs will be displayed during the ordering process. Your order will be shipped from our warehouse within 1 to 3 business days, unless a different delivery time has been agreed upon.  . Once you receive the tracking number, DHL typically requires an additional 1 to 3 business days for deliveries within Germany. For shipments within Europe, delivery may take up to 7 business days.

6.3. The seller assumes no liability for delivery delays caused by force majeure, unforeseeable events, or actions of third parties (e.g., transport companies).

7. Right of Withdrawal
7.1. Customers have the right to withdraw from the contract within 14 days without stating any reasons. The withdrawal period is 14 days from the day on which the customer or a third party nominated by the customer takes possession of the last good.

7.2. To exercise your right of withdrawal, you must inform us (umewe, Nisa Anton, Rathausallee 104, 22846 Norderstedt, E-mail: info@umewe.eu) by means of a clear statement (e.g., by letter or email) of your decision to withdraw from this contract. The sample withdrawal form can be downloaded here.

7.3. The returned goods must be in their original condition, including all woven and paper labels. If the returned items show stains or other damage, we cannot accept them and will return them to you at your expense.

7.4. In the event of a withdrawal, we will reimburse all payments we have received from you, including the costs of delivery, without undue delay and no later than 14 days from the day we are informed of your decision to withdraw from the contract. We will use the same payment method for the reimbursement that you used in the original transaction unless explicitly agreed otherwise.

7.5. The customer bears the cost of returning the goods. Returns must be made insured and with tracking.

8. Damage During Transport
If goods are delivered with obvious transport damage, please notify the carrier of such errors immediately and contact us without delay. Failure to make a complaint or contact us will not affect your legal rights, especially your warranty rights. However, it will help us assert our own claims against the carrier or transport insurance.

9. Warranty and Defects
9.1. The statutory warranty applies. The customer has the right to claim warranty for defective goods within two years of delivery. The warranty does not cover damages resulting from normal wear and tear, negligent handling, improper use, or failure to follow care or operating instructions.

9.2. If the delivered goods are defective, the customer can request either rectification or replacement. If rectification or replacement fails, the customer can, at their discretion, demand a reduction in the purchase price or withdraw from the contract.

10. Liability
10.1. The seller is only liable for damages caused by intentional or grossly negligent conduct.

10.2. For damages caused by simple negligence, the seller is only liable if an essential contractual obligation is violated, the fulfillment of which is necessary for the proper performance of the contract, and on which the customer may regularly rely.

11. Data Protection
The seller processes the personal data of the customer in accordance with the General Data Protection Regulation (GDPR). For more information, please refer to our privacy policy, which is available on our website.

12. Final Provisions
12.1. The law of the Federal Republic of Germany applies. The provisions of the UN Sales Convention do not apply.

12.2. If the customer is a merchant, the place of jurisdiction for all disputes arising from the contractual relationship is the seller's place of business.

12.3. If any provision of these AGB is or becomes invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the provision that comes closest to the economic purpose shall apply.
